Terms of Service

These Terms of Service ("Terms") govern your use of the SafePlate mobile application and website at mysafeplate.app ("Service"), operated by SafePlate ("we", "our", "us"). By using SafePlate, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use SafePlate. By creating an account, you confirm that you meet this age requirement.

2. Important Disclaimer

You acknowledge and agree that:

• SafePlate's menu analysis is generated by artificial intelligence and may contain errors, omissions, or inaccuracies.
• Ingredient information may be incomplete, outdated, or incorrect. Restaurants change their menus and recipes without notice.
• SafePlate cannot account for cross-contamination risks, kitchen practices, or undisclosed ingredients.
• You must always inform restaurant staff of your allergies before ordering, regardless of SafePlate's analysis.
• SafePlate should be used as a supplementary tool, not as your sole source of allergy safety information.

3. Limitation of Liability

To the maximum extent permitted by law, SafePlate and its officers, directors, employees, and agents shall not be liable for any allergic reaction, injury, illness, death, or any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on the Service.

You use SafePlate entirely at your own risk. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose.

4. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your allergy profile.
• You may delete your account and all associated data at any time from the Profile screen.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or abuse the Service's API
• Submit false or misleading feedback on dish analyses
• Upload content that is harmful, offensive, or violates third-party rights
• Circumvent rate limits, authentication, or security measures

6. Subscriptions and Payments

• SafePlate offers free and paid subscription tiers.
• Paid subscriptions are billed monthly or annually through the Apple App Store or Google Play Store.
• You may cancel your subscription at any time through your device's app store settings.
• Refunds are handled according to the policies of the Apple App Store or Google Play Store.

7. User-Submitted Content

When you submit feedback (e.g., thumbs up/down on dish analyses) or upload menu photos, you grant SafePlate a non-exclusive, royalty-free license to use this content to improve the Service. You retain ownership of any photos you upload.

8. Intellectual Property

The SafePlate name, logo, and all content, features, and functionality of the Service are owned by SafePlate and protected by copyright, trademark, and other intellectual property laws.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may terminate your account at any time by using the "Delete My Account" feature.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of SafePlate after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
